Terms & Conditions
These terms and conditions form the basis of the agreement between you the customer and Charlotte Hughes trading as the owner of Charly’s Bakes. These Terms along with yourorder form and order confirmation are considered to set out the agreement between youand Charly's Bakes for the sale of cakes. It is your responsibility to check all details in the order form and confirmation are complete and accurate as this is the document I work to when completing your order.
Ordering
Cakes should ideally be ordered a minimum of 1 month in advance. However please contact me to discuss, I we will try and accommodate last minute orders. I only work on a small number of cakes a week so that I can maintain the quality, so order as early as possible to avoid disappointment. Quotes are only valid for 30 days from date of quoting.
Deposit and Payment

Your order is not confirmed nor fully booked until a 50% deposit for a celebration cake, or products below £40 a full payment is required with your order.

By paying a deposit to secure your booking, you are confirming your acceptance of theTerms and Conditions and details set out on the order form.

The balance must be paid no later than 14 days before the celebration cake is due to be collected and no later than the date set out in the order confirmation by bank transfer to the account specified.

Cakes ordered within 2 weeks of collection, a full payment is required with the order. Unfortunately the deposit is non-refundable upon cancellation.

If payment is not received by the date specified this shall be constituted as breach to the agreement by the customer. I reserve the right to hold the order until payment is made in full. When payment is late I accept no responsibility should I be unable to purchase the required stock or equipment to make the cake as laid out in the order confirmation. In these circumstances the cake will be made as close to the order confirmation as possible with no redress or liability on Charly's Bakes.
Check Your Order
I will email a copy of the cake order form and confirmation of booking, please check andensure all details are correct e.g. dates, spelling of names etc. It is the customers responsibility to check that the details on the order are correct.
The Cakes

I warrant that on collection of the celebration cake or items that the description as set out in the order confirmation, be of satisfactory quality and comply with all food safety, statutory and regulatory requirements in the UK. Charly's Bakes will not be held responsible for customer disappointment of the design or the interpretation of the cake as long as it is made in line with the customer’s pre-agreed requirements set out in the order form and will face no consequent liability. It is the customer’s responsibility to ensure all details within the order confirmation are correct and meet their exact requirements.

The warranty does not apply to any defect in the cakes arising from wilful damage, accident, negligence by you or any third party, use of the cake in a way I do not recommend, failure to follow my instructions or any alterations you carry out.

I cannot guarantee an exact replica of any cake but I will do my best to make it so. Where colour swatches are provided I will do my best to match as close as I deem possible. Exact colour matches are not guaranteed. If you have provided a photo as a reference, you understand there may be some variation from the original.

Any samples, drawings, or descriptions I issue and any descriptions or illustrations contained on my website are issued solely to provide you with an approximate idea of the cakes they describe and remain the property of Charly's Bakes.

From time to time certain materials for my cakes may become obsolete. This is totally out of my control; however I will do my best to select replacement products to reflect the original design as closely as possible. I reserve the right to replace items with component parts of equal or better quality without consultation.

Cakes are fresh products containing no additives or preservatives and it is my right to assume consumption on the day requested. Cakes should be stored in a dry place, at room temperature, away from direct sunlight and sources of heat, in the box provided. They should NOT be refrigerated unless advised otherwise.

Charly's Bakes and the customer expressly agree that the cakes and all goods purchased from Charly's Bakes remain the property of Charly's Bakes until paid for in full.

You agree that images of the cake may be shown on social media or on Charly's Bakes website. These images are the property of Charly's Bakes but I will never post a picture before the event date on your order form. Please advise in writing if you'd prefer any names or images of people which may be displayed on the cake to be made unrecognisable for the photo.
Prices and Payment
The price of your cake will be as set out in your order confirmation. No VAT is payable on the cakes. A 50% non refundable deposit is required for cake orders or products below £40 a full payment is required with your order.
The balance must be paid in cleared monies no later 14 days before the collection date set out in the order confirmation by bank transfer to the account specified.
Cancellation Postponement & Alterations

In the event of a cancellation by the customer, charges are as follows;

More than 14 days prior to the date: non-refundable deposit.

Less than 14 days prior to the date: full amount payable.

Any deposit previously paid are non-refundable.

I will be as accommodating as reasonably possible should you wish to amend your order which you must provide me in a written notice. In the case of alterations, a new order confirmation will be issued detailing the changes and the new cost. Alterations are not confirmed until a new order confirmation has been issued. Should you make any changes after the time of booking there will be no a reduction in the price you pay, even if your new design is cheaper than the original booking.

If for any reason you fail to collect your cake order, I reserve the right to take action to recover any balance outstanding.

If you need to change the date of your order after the deposit has been paid, I will do my best to accommodate your request, otherwise cancellation terms apply.

In the unlikely event that I need to cancel your order any monies paid will be refunded. Charly's Bakes reserves the right to cancel, vary or suspend the operation of this contract if events occur which are in the nature of force majeure including (without prejudice to the generality of the foregoing): fire, floods, storm, plant breakdown, strike, lock outs, riot, hostilities, non-availability of materials or supplies or any other event outside the control of Charly's Bakes and Charly's Bakes shall not be liable for any breach of agreement resulting from such an event.

Charly's Bakes shall not under any circumstances be liable for the customer in respect of indirect consequential loss or damage or loss of profits, provided always that these conditions do not exclude or restrict Charly's Bakes statutory liability for death or personal injury arising from any negligence on Charly's Bakes part or liability imposed by statutory implied terms in Consumer Contracts.
Customer Satisfaction

If you are unhappy with anything, please do talk to me. I appreciate it can be a daunting process ordering a custom made cake, so please make sure you check that the description on your order form matches the design you want as this will be what I use when I come to make your cake. I am more than happy to make as many changes to the design as you need to make sure the product is perfect for your celebration.

Due to the amount of work put into each individual cake I take complaints very seriously. Both Parties agree to not post any negative information about the other arising out of this agreement or Event on any online forum or website without providing advance written notice of the intended content there of, and providing the other party with a prior opportunity to resolve any issues between the parties amicably.

It is the customer’s responsibility to ensure the cake is correct before leaving thepremises. Any issues must be raised at the time before the cake leaves Charly's Bakes togive me the opportunity to correct them.

Where the complaint is in regards to the quality of the cake then the cake, or remainder of the cake/tier, must be returned to me as soon as possible after cutting and within 48 hours of collection to ensure that I can fairly assess the nature of the complaint.
